1. Application
These general terms and conditions of sale govern all sales contracts concluded between CAM and its customers. Consequently, the fact of placing an order implies the full and unreserved acceptance by the buyer of these general terms and conditions of sale. The fact that CAM does not avail itself, at a given time, of any of these general terms and conditions of sale cannot be interpreted as a waiver of the right to avail itself of any of these conditions at a later date.
2. Order taking
In accordance with professional practice, orders are placed by telephone, fax, internet or mail.
For orders placed over the Internet, the customer validates his order when he clicks on the "next" button after having selected a mode of payment; he then accepts the order process and these terms and conditions of sale. The customer then receives an email of confirmation automatically.
Our general terms and conditions of sale are applied to all our sales. By placing an order, the customer accepts without reservation our terms and conditions of sale.
The customer has a period of 7 days from the delivery date to return the product (the return costs being at his expense). It is then refunded (excluding shipping costs) the price of the product in the month of receipt of it. However, products returned incomplete, damaged or soiled will not be taken back. This right of withdrawal cannot be exercised for computer software when it has been unsealed. No cash on delivery will be accepted for any reason whatsoever.
3. Price
All prices indicated on the website www.medical.fr are duty free, in Euros, departing from Montreuil and against payment without discount.
All prices indicated on the invoice are inclusive of VAT, in Euros, ex Montreuil and against payment without discount.
These rates may be modified at any time, without notice and, in particular, in case of any changes in tax or economic data. Invoices are issued in accordance with the rate valid on the day the order is placed.
4. Payment - Terms and conditions
Our invoices are payable upon receipt. Any sum not paid within the maximum period of 30 days shall automatically and without prior formal notice, notwithstanding Article 1153 of the Civil Code, be subject to late payment penalties in the form of late payment interest calculated at a legal rate of 1.7 times the legal interest rate on the day on which such late payment interest is charged. These penalties will be applied until full payment is made.
5. Shipping and preparation costs
The prices mentioned are EXCLUDING TAXES, departure Montreuil. An estimate for any handling and shipping costs can be prepared and provided on request.
6. Delivery deadlines
The delivery times indicated in our catalogue, website, quotation, proforma invoice, although determined as precisely as possible, do not constitute a commitment on our part. Any penalty for delay is excluded.
The goods are shipped at the risk and peril of the customer, who is responsible for checking that they are in good condition at the time of delivery. This control must cover the references, quantities, quality of the goods as well as the conformity to the order. No complaint will be taken into account after a period of 7 working days from the delivery date.
If the goods have been confided to a carrier and have suffered losses or damage, the customer must make precise and complete reservations on the transport document and restate his justified protest in the forms and within the time limits provided for in Article 105 of the French Commercial Code.
For bulky goods it is the customer's responsibility to check in advance the accessibility of the place of delivery (width of doors, corridors, etc.). In the event of an accessibility problem, the additional costs incurred (disassembly and/or reassembly of the products, second passage of the carrier, etc.) will be invoiced in full to the customer.
7. Partial Deliveries
Unless otherwise specified on the order slip, we will immediately ship the items constituting homogeneous batches, usable and available in our stores, the order balances will be the subject of subsequent additional deliveries.
8. Claims and reclamation
Any reclamation concerning the quantities, the forms ordered and the condition of the goods must, in order to be admissible, be addressed within 7 days of receipt of the goods to CAM. Any claim deemed justified will give rise to a credit note net of taxes.
9. Retention of Title Clause
CAM retains ownership of the goods sold until actual payment of the full price. Failure to pay any of the due dates may result in the return of the goods at the buyer's risk. These provisions do not prevent the transfer to the buyer of the risks of loss and deterioration of the goods sold upon delivery. The buyer shall bear all legal and judicial costs resulting from a contentious action.
10. Guarantee
Medical.fr sells second-hand products in good working order. Unless explicitly stated otherwise, our devices are guaranteed simply when they are put into operation.
For guaranteed machines, we invite you to contact us on 00 33 1 49 20 86 90 to have your guarantee activated. As soon as we receive your device, we will contact you within 48 hours to give you a precise repair time. Texts and photos are non-contractual.
11. Contestation
Unless CAM prefers to bring the matter before any other competent court, any dispute relating to sales (disputes relating to training, execution of orders, supply, payment, etc.) will fall within the exclusive jurisdiction of the Bobigny Commercial Court. This clause applies notwithstanding any clause to the contrary, even in the event of summary proceedings or multiple defendants and regardless of the method or terms of payment.
12. Applicable Law
All sales concluded by our company are subject to French law.
The contractual information is presented in French and the products offered for sale comply with French regulations. If necessary, it is the responsibility of the foreign customer to check with the local authorities the possibilities of use of the product he intends to order;
In the event of a dispute, the French courts have exclusive jurisdiction.
13. Competencies
For all disputes relating to sales made by our company and the application or interpretation of these general terms and conditions of sale, the Bobigny Commercial Court shall have sole jurisdiction.

14. Confidentiality
14.1 Nominative information
When placing your orders, we ask you for your first and last name, address, telephone number and email. This information that you provide to us is not disclosed to third parties except:
